1. Purpose

The present general terms and conditions (hereinafter, the "GTC") define the terms and conditions that are applicable when a person (hereinafter, the "Customer") orders and purchases products sold by Méert (hereinafter, "Méert") on the website www.meert.fr (hereinafter, the "Website").

2. Application and enforceability of the GTC

Before being able to place an order, each Customer must acknowledge and agree to the GTC.

By placing an order, the Customer therefore accepts the GTC in full and without reservation.

Unless explicitly authorized by Méert, no special conditions or other general conditions provided by the Customer shall prevail over the GTC.

3. Characteristics of goods

All products on the Website are available for purchase by the Customer, provided they are in stock and the Website and/or mobile application is functioning properly.

Each product is presented with a photograph and a description provided by Méert. Méert shall in no way be held liable for the content of descriptions, which are simply intended to present the essential characteristics of products before Customers finalize their order.

Product photos are provided for informational purposes only and are in no way contractually binding. Under no circumstances may the Customer request that the composition or presentation of products be altered.

4. Placing orders and order confirmations

When placing an order on the Website, the Customer is responsible for completing each field in the order form correctly (address, date and time of pickup, billing address, payment method, etc.).

Méert will confirm the order and payment:

  • On the Website, following the payment
  • By email to the email address provided by the Customer.

Méert will do its best to honor any order modification requests submitted by the Customer, provided the Customer sends the request at least 72 hours before the agreed-upon pickup date and time of the order. If Méert is unable to make the requested changes, the Customer will be refunded the respective order amount within 7 days.

5. Prices

All product prices are net prices and include taxes. Prices are valid for as long as supplies last, and provided the VAT rate does not change. Prices are listed in euros.

Shipping fees are extra and calculated according to the place of delivery.

The following shipping fees apply:

  • France (mainland) and Belgium: €8
  • Rest of Europe: €20

Certain pastries cannot be shipped as they are too fragile; they can, however, be picked up from our store in Lille on Rue Esquermoise.

Shipping is free for orders of €80 or more to mainland France, and €150 or more to other countries in Europe. Offer valid only for orders placed by non-business Customers on the Website with delivery to a single address in Europe or mainland France. This offer is not valid for corporate orders or special orders placed in our stores.

6. Payment methods

On the Website, the Customer may only pay by credit card (VISA, MASTERCARD or AMERICAN EXPRESS) via the secure online payment system of our electronic payment provider OGONE. Credit card payments are authorized immediately.

Orders are not confirmed until they are paid in full. Unpaid orders will not be processed. We are never in possession of your credit card information; instead, it is entered directly on the secure server of our payment service provider, OGONE. OGONE uses the most demanding security standards on the market, including SSL 3.0 and 128-bit encryption. OGONE is also certified by AE (TDC), MasterCard, and VISA (PCI DSS) for compliance with strict security standards.

Once the payment is confirmed, a document summarizing the information of the order (order number, date and time of pickup, etc.) is sent to the Customer by email. This document serves as a proof of payment when the Customer picks up their order from the stores.

The Customer will also receive an invoice for the order by email.

7. Picking up orders

All products sold on the Website can be picked up in our stores.

Customers can pick up their orders from our main store located at 27 Rue Esquermoise in Lille, as well as from the Méert corner in "La Piscine" Museum in Roubaix (23 Rue de l'Espérance), during regular store hours. Customers may only pick up their orders on the date and time that they selected when placing their orders on the Website. Customers may also authorize a third party to pick up their order.

Customers must have their order number on hand, or they will not be able to pick up their order. Given the perishable nature of our goods, Méert shall not be held responsible if the quality of an order suffers due to a late pickup. Furthermore, any order not collected by the Customer on the selected pickup day will be destroyed, with the Customer forfeiting any right to a refund or compensation.

All orders placed before 4 pm will be available in the store the following day.

8. Delivery

Delivery methods:

Depending on the products ordered, the Customer may choose from the following delivery methods:

  • Home delivery Express
  • Delivery by courier

8.1 – Home delivery by carrier

Orders are shipped with Colissimo or Chronopost.

Shipping fees are extra and calculated according to the place of delivery:

Colissimo:

  • France (mainland) and Belgium: €7.90 (free for orders of €80 or more)
  • Europe: €20 (free for orders of €150 or more)

Chronopost:

  • Mainland France: €9.90 (free for orders of €90 or more)·

Orders placed on the Website before 12 pm are prepared and dispatched the same day, while orders placed after 12 pm are prepared and dispatched the following day (except weekends and public holidays). Orders placed on the Website after 12 pm on Friday until 12 pm on Monday are dispatched on that Monday.

The following delivery times apply for Colissimo:

Delivery to mainland France and the principalities of Andorra and Monaco:
• 24-72 hours after dispatch,* Monday to Friday Delivery to Europe and Switzerland: • 48-72 hours after dispatch,* Monday to Friday

*Average delivery time The following delivery times apply for Chronopost:

Delivery to mainland France and the principalities of Andorra and Monaco:
• 24 hours after dispatch,* Monday to Friday

*Orders placed on Friday before 12 pm are delivered the following Monday. No delivery on Saturdays.

These delivery times are approximate and provided for informational purposes only.

Deliveries are made directly to the Customer's residence. If the Customer is not home, a delivery notice is left. 

Méert shall not be held responsible for any damage to products if a package is opened during transit, or for any deterioration in quality due to a recipient being absent during an attempted delivery.

Méert shall also not be held responsible if a package cannot be delivered due to a natural disaster or force majeure.

8.2 – Express delivery by courier

All products sold on the Website can be delivered by courier.

The following delivery times apply for couriers:

Orders placed Monday to Friday before 4 pm: delivery from the next day between 10 am and 8 pm (except Sunday and Monday).

Orders placed on Saturday or Sunday before 4 pm: delivery from the following Tuesday.

The Customer can select a 2-hour delivery slot when placing an order (10 am to 12 pm – 12 to 2 pm – 2 to 4 pm – 4 to 6 pm – 6 to 8 pm). Once their order is validated, the Customer will receive a call from the courier delivery service to confirm the selected time slot. Méert reserves the right to propose another slot, depending on the courier's availability.

The following cities are eligible for delivery by courier:

  • Lille city limits (€10), free for orders of €100 or more
  • Lille outskirts (€20), free for orders of €150 or more: Bondues, Croix, Capinghem, Fâches-Thumesnil, Hellemmes, Hem, La Madeleine, Lambersart, Lezennes, Lomme, Lompret, Loos, Marcq en Baroeul, Marquette, Mons en Baroeul, Mouvaux, Premesques, Ronchin, Roubaix, Saint-André, Sequedin, Tourcoing, Villeneuve d'Ascq, Wambrechies, Wasquehal, Wattignies.

If the Customer is not home at the time of the delivery, the courier will be required to try again at a later time (based on their availability), all the while giving preference to their scheduled deliveries. Given the perishable nature of our goods, Méert shall not be held responsible if the quality of an order suffers due to a Customer being absent during an attempted delivery. Furthermore, any order not delivered on the selected delivery day will be destroyed, with the Customer forfeiting any right to a refund or compensation.

Finally, Méert shall not be held responsible if a package cannot be delivered due to a natural disaster or force majeure.

9. Proof

Méert (via its host AWS) stores purchase orders and invoices on IT systems with sufficient levels of security.

The digital records of AWS are therefore a reliable and durable medium that may be used as proof.

10. Right of withdrawal (cooling-off period)

The legal 7-day cooling-off period does not apply to perishable food products such as the goods sold by Méert. As a result, the Customer cannot take advantage of the right of withdrawal.

11. Stock shortages (supply)

Méert products are made by hand and available while supplies last.

In the event that the requested products cannot be provided, Méert will contact the Customer by telephone to:

Postpone the order date until the product is in stock (if possible).

Replace the unavailable product with a product that is equivalent in quality and price.

Méert products are made by hand and available while supplies last. Given the large number of orders placed during holidays, we are more likely to encounter stock shortages during these periods than other periods of the year.

In the event of an oversight or error in the preparation of an order, the missing product(s) will be refunded but the Customer will not be entitled to any other compensation or deduction.

12. Claims and refunds

When picking up an order, the Customer must check the order to make sure it is correct. In order to be considered, a claim or complaint for non-conformity or visible product defects must be made at the time that the order is picked up.

The Customer may not make a claim regarding the taste, freshness, or presentation of products.

In the event of non-conformity or a visible defect, the Customer must clearly indicate the problem on the purchase order, followed by the date and their signature. Méert shall replace - as quickly as possible and at its own expense - any products whose visible defects or lack of conformity has been duly proven by the Customer.

13. Product guarantee

Méert guarantees that its products are made and packaged in accordance with strict quality standards, and preserved in accordance with all applicable French regulations.

However, Méert cannot guarantee the quality of its products if the Customer fails to store products in the recommended storage conditions, or has consumed products after the best-before date indicated on the packaging.

The best-before date of our products is indicated on the bottom of each box or package.

For maximum enjoyment, we recommend consuming your products as quickly after the pickup date as possible.

14. Intellectual property

All elements on the Website (photos, illustrations, pictograms, descriptions, logos, branding, etc.) are and remain the exclusive intellectual property of Méert.

Any reproduction, representation, redistribution, or use, even in part, of any of the elements on the Website (including software, visual elements, and sound), for any purpose whatsoever, is strictly forbidden without the express prior authorization of Méert, the holder of all intellectual property rights.

15. Protection of personal data

By placing an order on the Website, the Customer agrees that Méert may use their personal data. This data is necessary to ensure the proper processing of orders.

All such information is treated with the utmost care and discretion. The file containing this data has been reported to the CNIL (number 1812266).

As per Article 34 of the French Data Protection Act of January 6, 1978, the Customer has the right to access or rectify their personal data, or request that such data be deleted. To exercise their rights and/or obtain more information, the Customer may contact Méert using the contact details in the "Contact" section.

All requests are processed within one month.

16. Severability

If one of the clauses in the GTC becomes inapplicable or invalid for any reason whatsoever, this shall not affect the application or validity of the remaining clauses, and the invalid or inapplicable clause will be replaced with a clause that comes closest to the original clause in meaning.

17. Force majeure

Neither Méert nor the Customer shall be held liable for any failure to fulfill, within or beyond the allotted time, any of the obligations described in the GTC due to force majeure.

Force majeure is understood as any external, unforeseeable, and uncontrollable event, as per Article 1148 of the French Civil Code. The following are considered clear cases of force majeure or fortuitous events, in addition to those usually accepted by the French justice system: total or partial strikes, lockouts, riots, civil unrest, insurrections, war, bad weather, epidemics, the blocking of transportation or supply routes for any reason whatsoever, earthquakes, fires, storms, floods, water damage, governmental or legal restrictions, legal or regulatory changes to forms of marketing, computer failure, the blocking of telecommunications systems (including telecommunications networks), any challenge to the mathematical foundations governing the theory of cryptographic algorithms used for public key infrastructures, and any other event beyond the control of the parties preventing the proper execution of the contract.

18. Applicable law The GTC are governed exclusively by French law.

The Commercial Court of Lille shall have sole jurisdiction over any dispute or disagreement resulting from the GTC.

19. Restrictions

The Customer may not, under any circumstances, resell the products that have been ordered for their own personal use or for that of the recipient of the order.
